READ THESE TERMS AND CONDITIONS (“TERMS”) CAREFULLY BEFORE PARTICIPATING IN ANY OFFER TO BE PART OF A GIVEAWAY, PROMO CREDIT, OR INTERESTED USER PROGRAM WHERE NO PURCHASE IS NECESSARY TO RECEIVE THE GIVEAWAY, PROMO CREDIT, OR PARTICIPATE AS AN INTERESTED USER (EACH AN “OFFER”). YOU WILL BE DEEMED TO HAVE ACCEPTED THESE TERMS AND AGREE TO BE BOUND BY THEM WHEN PARTICIPATING IN ANY OFFER.

The Sweet Terms of Use and Privacy Policy apply to and control the use of any Sweet service, the Sweet platform, and any digital collectible redeemed in response to any Offer. When we use the term “Sweet” “we” or “our” in these Terms, we are referring to SocialSweet Inc. or, as applicable, its Brands, as defined in the Terms of Use. When we use the term “you” in these Terms, we are referring to you, the participant in the Offer.

1. These Terms apply to all Sweet Offers, unless otherwise specified.

2. You must complete Sweet’s registration and be in compliance with the Sweet Terms of Use to be eligible to receive the Offer.

3. By initiating registration on the Sweet Platform and sharing information, you agree that Sweet may use any such information (including personal information like email, phone, or other) to contact you to verify your interest or lack thereof, to confirm your participation or decision not to participate, to verify your eligibility for an Offer, and/or for quality control purposes.

4. Certain Offers may only be available to customers in select jurisdictions.

5. Certain Offers may only be redeemed by new users of the Sweet Platform or Sweet Services or on a user’s first transaction. If so, you will not be eligible for the Offer if you have previously used Sweet and/or have a Sweet account.

6. You may be disqualified and/or not entitled to receive an Offer if Sweet determines, in its sole discretion, that you are using a VPN, shared device, shared identification or payment credentials, or are otherwise suspected of suspicious or fraudulent activity.

7. If an Offer includes a discount on fees, such discount shall only apply to the listed price of an item for sale on Sweet’s Platform and shall not apply to third party fees such as payment processing or network fees.

8. Each Offer is a limited time offer and if not otherwise stated expires after 30 days.

9. Each Offer is limited to one per verified registered user.

10. Each Offer is good while supplies last and subject to availability.

11. An Offer may not be combined with other offers or promotions.

12. An Offer cannot be sold, auctioned, or traded and are non-transferable, unless expressly authorized by Sweet.

13. Offers cannot be applied retroactively to goods or services already purchased.

14. Unless otherwise stated, the expiration of an Offer shall be at 11:59 p.m. ET on the applicable end or expiration date or earlier exhaustion of the limited supply.

15. You are responsible for paying any applicable tax related to the use or receipt of any Offer. Sweet has no obligation for payment of any tax in conjunction with the distribution or use of any Offer.

16. If applicable, third party terms and conditions may apply to any part of the Offer.

17. We do not assume any responsibility for any typographical or other error in the administration of the Offer.

18. We reserve the right to void, cancel, suspend, or amend the Offer.

19. We reserve the right to modify and amend these terms and conditions from time to time during the Offer.

20. Void where restricted or prohibited by law. In the event that any provision of these Terms is unenforceable under applicable law, the validity or enforceability of the remaining provisions will not be affected. To the extent any provision of these Terms is judicially determined to be unenforceable, a court of competent jurisdiction may reform any such provision to make it enforceable. The provisions of these Terms will, where possible, be interpreted so as to sustain its legality and enforceability.

21. Our failure to enforce any of these Terms will not constitute a waiver of any Terms.
